1About Spamvora
Spamvora (“we,” “us,” “our,” or the “Company”) is an AI-powered lead intelligence and spam protection platform delivered as a Software-as-a-Service (SaaS) product. The Service is accessed through a WordPress plugin and a cloud-based scoring dashboard.
Spamvora helps businesses, developers, and marketing agencies automatically filter spam form submissions, score lead quality in real time, and protect advertising budgets from fraudulent or bot-generated traffic.
Spamvora is operated as a sole proprietorship based in Bengaluru, India. Our website is located at spamvora.com.
2Definitions
- “Service” — The Spamvora platform, WordPress plugin, REST API, web dashboard, website, documentation, and all associated features and updates.
- “User,” “you,” “your” — Any individual or legal entity that creates an account, purchases a subscription, or otherwise accesses the Service.
- “Subscription” — A paid recurring plan (monthly or annual) granting access to the Service.
- “Razorpay” — Razorpay Software Private Limited, an RBI-licensed Payment Aggregator that processes all payment transactions for Spamvora subscriptions.
- “Resend” — Resend, Inc., a US-based transactional email platform (SOC 2 Type II certified, GDPR and UK GDPR compliant) used by Spamvora to send all account, billing, and service emails.
- “Content” — Any data, text, records, or materials you submit to the Service.
- “End Users” — Visitors or customers of your website whose form submission data is processed by Spamvora on your behalf.
- “Intellectual Property” — All patents, trademarks, copyrights, trade secrets, algorithms, branding, and proprietary technology owned by or licensed to Spamvora.
- “DPDPA” — The Digital Personal Data Protection Act, 2023 (India).
- “IT Act” — The Information Technology Act, 2000 (India) and its amendments.
- “UK GDPR” — The UK General Data Protection Regulation as retained in UK law under the Data Protection Act 2018, enforced by the Information Commissioner’s Office (ICO).
- “GDPR” — The General Data Protection Regulation (EU) 2016/679, applicable to users in the EU and EEA.
3Eligibility
To use the Service, you must:
- Be at least 18 years of age — the age of majority under the DPDPA 2023 and applicable Indian law;
- Have full legal capacity to enter into a binding contract on behalf of yourself or your organization;
- Not be prohibited from using digital payment services or receiving software services under any applicable Indian, UK, US, or international law;
- Not be on any government-issued list of prohibited, restricted, or sanctioned parties (including OFAC, HM Treasury, or UN sanctions lists);
- Provide accurate, truthful, and complete registration information at all times.
By creating an account, you represent and warrant that you meet all eligibility requirements above.
4Account Registration and Security
You must create an account to access paid features of the Service. By registering, you agree to:
- Provide accurate, current, and complete registration information;
- Keep your registration information updated at all times;
- Maintain strict confidentiality of your password and API credentials;
- Notify us immediately at info@spamvora.com if you suspect any unauthorized access to your account;
- Accept full responsibility for all activities conducted under your account, whether authorized or not.
We reserve the right to disable or suspend any account at our discretion if credentials are compromised, if these Terms are violated, or if continued account activity poses a risk to the Service or other users. You may not create multiple accounts to circumvent restrictions, access controls, or trial limitations.
5Subscriptions, Billing, and Payment Processing
5.1 Subscription Plans
Spamvora offers monthly and annual subscription plans. Current pricing, plan features, and usage limits are described on our Pricing page. We reserve the right to change pricing with at least 30 days’ advance notice to existing subscribers.
5.2 Payment Processor — Razorpay
All payments for Spamvora subscriptions are processed exclusively by Razorpay Software Private Limited (“Razorpay”), a company incorporated under the laws of India and licensed as a Payment Aggregator by the Reserve Bank of India (RBI).
Accepted payment methods via Razorpay:
- Credit cards and debit cards (Visa, Mastercard, RuPay, American Express)
- UPI — including Google Pay, PhonePe, Paytm UPI, BHIM, and all UPI-enabled apps
- Net Banking — all major Indian banks
- Digital Wallets — Paytm, Mobikwik, Freecharge, and others
- EMI — select credit cards, subject to individual bank eligibility
5.3 Automatic Renewal
All subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current rate, unless you cancel before the renewal date. By purchasing a subscription, you expressly authorize Razorpay to charge your payment method on a recurring basis without further notice, until you cancel. We send advance renewal reminder emails via Resend before every renewal (14 days and 3 days before annual renewals; 3 days before monthly renewals).
5.4 GST and Taxes
All prices displayed are inclusive of applicable Goods and Services Tax (GST) for Indian customers. GST is collected and remitted by Razorpay on our behalf in compliance with the Central Goods and Services Tax Act, 2017. A GST invoice will be issued for every transaction and sent to your registered email address via Resend. For international customers, you are responsible for any taxes applicable in your jurisdiction.
5.5 RBI Data Localization
In compliance with the RBI Master Direction on Storage of Payment System Data (2018), all payment transaction data processed through Razorpay is stored on servers located within India. We do not store, transfer, or process payment card numbers, UPI IDs, bank account numbers, or CVV data outside India. We do not store this sensitive payment data on our own servers at all — it is handled exclusively by Razorpay’s PCI-DSS certified infrastructure.
5.6 Failed Payments
If a payment fails, Razorpay may attempt to retry the charge. If payment cannot be collected, your access to paid features will be suspended until the outstanding balance is resolved. We will notify you by email via Resend if your payment fails.
5.7 Price Changes
We reserve the right to modify subscription pricing with at least 30 days’ advance notice sent to your registered email. Continued use after the effective date constitutes acceptance of the new pricing.
6Cancellation and Refunds
6.1 Cancellation
You may cancel your subscription at any time through your account dashboard or by emailing info@spamvora.com with subject “Cancel Subscription.” Cancellation takes effect at the end of the current paid billing period. You retain full access to the Service until that date. A cancellation confirmation will be sent via Resend within 24 hours.
6.2 Refund Policy
Our complete refund terms are described in our Refund Policy, which is incorporated into these Terms by reference. In summary, we offer a 7-day refund window on new subscriptions. Refunds approved by Spamvora are processed through Razorpay and typically appear within 5–7 business days, depending on your payment method.
6.3 No Refund for Policy Violations
Accounts suspended or terminated due to violations of these Terms, the Acceptable Use Policy, or any applicable law are not eligible for refunds of any kind.
7Email Communications and Resend
Spamvora sends all emails exclusively through Resend (resend.com), a US-based transactional email platform that is SOC 2 Type II certified and compliant with GDPR and UK GDPR. We maintain strict compliance with all applicable anti-spam laws including the CAN-SPAM Act (USA), CASL (Canada), GDPR (EU), UK GDPR (United Kingdom), and India’s IT Act 2000 and DPDPA 2023.
7.1 Transactional Emails
The following emails are sent as essential service communications and cannot be unsubscribed from while your account is active:
- Account registration confirmation and email verification
- Password reset requests
- GST invoices and payment receipts (triggered by Razorpay transactions)
- Subscription renewal reminders (14 days and 3 days before annual; 3 days before monthly)
- Subscription cancellation and refund confirmations
- Critical security alerts (unauthorized login attempts, password changes)
- Plan change and account status notifications
- Service maintenance or outage notices
7.2 Marketing Emails
We send marketing emails — product updates, new features, tips, promotional offers — only to users who have given explicit, prior opt-in consent. You may withdraw consent at any time by clicking the Unsubscribe link in any marketing email (one-click unsubscribe, RFC 8058 compliant) or by emailing info@spamvora.com with subject “Unsubscribe.” Opt-out requests are processed within 10 business days (CAN-SPAM), 30 days (UK GDPR), and 5 business days (DPDPA 2023).
7.3 Anti-Spam Standards
✓ All emails use accurate sender identification and non-deceptive subject lines
✓ Every marketing email includes a working one-click unsubscribe mechanism
✓ We maintain and permanently honor email suppression lists
✓ We monitor bounce rates (<5%) and spam complaint rates (<0.1%) per Resend’s sending policy
✓ All outbound email is authenticated with DKIM, SPF, and DMARC
✓ Compliant with CAN-SPAM (USA), CASL (Canada), GDPR (EU), UK GDPR (United Kingdom), and India IT Act / DPDPA 2023
8Acceptable Use Policy
You agree to use the Service only for lawful, legitimate purposes consistent with these Terms. You must not use the Service in any way that:
- Violates any applicable local, national, or international law or regulation, including the IT Act 2000, DPDPA 2023, UK GDPR, or GDPR;
- Infringes the intellectual property, privacy, or other legal rights of any third party;
- Involves sending unsolicited commercial email (spam) of any kind;
- Introduces malware, viruses, ransomware, spyware, or harmful code into the Service or connected systems;
- Attempts to gain unauthorized access to any part of the Service, our servers, networks, or other users’ accounts;
- Overloads, impairs, or disrupts the integrity or performance of the Service infrastructure;
- Uses automated tools to scrape, harvest, or extract data from the Service without our prior written permission;
- Misrepresents your identity, affiliation, or the purpose of your use of the Service;
- Interferes with other users’ enjoyment of or access to the Service.
9Prohibited Activities
The following activities are strictly prohibited and will result in immediate account suspension or permanent termination without refund:
- Using the Service to facilitate phishing attacks, online fraud, identity theft, or social engineering;
- Distributing illegal content, hate speech, child sexual abuse material (CSAM), or any content that exploits or endangers minors;
- Using the Service to conduct, plan, promote, or support cyberattacks, DDoS attacks, or unauthorized network intrusions;
- Reselling, sublicensing, or white-labeling access to the Service without our prior written authorization;
- Reverse engineering, decompiling, disassembling, or attempting to extract source code from any component of the Service;
- Using the Service in connection with illegal gambling, counterfeit goods, illegal weapons, controlled substances, or any activity prohibited under applicable law;
- Providing materially false, inaccurate, or misleading information during account registration, KYC verification, or in communications with our team;
- Circumventing, disabling, or interfering with security features, rate limits, IP blocks, or access controls of the Service;
- Using the Service to send spam, bulk unsolicited email, or to harvest contact information without consent;
- Initiating fraudulent chargebacks or payment disputes in bad faith through Razorpay, your bank, or any UPI provider.
10Intellectual Property
All content, software, branding, trademarks, trade names, logos, designs, algorithms, machine learning models, and technology comprising or powering the Service are the exclusive intellectual property of Spamvora or its licensors, protected under Indian and international intellectual property laws including the Copyright Act, 1957 (India) and the Trade Marks Act, 1999 (India).
10.1 License to You
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes during your active subscription period.
10.2 Your Content
You retain ownership of any data or content you submit to the Service. By submitting content, you grant Spamvora a limited, worldwide, royalty-free license to access, process, and use your content solely to provide and improve the Service for you. We will not sell your content to third parties.
10.3 Restrictions
Without our express written permission, you may not: copy, modify, distribute, sell, or sublicense any part of the Service; create derivative works; use our brand names or logos; or frame or mirror any portion of the Service on any other platform.
10.4 Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, royalty-free license to use and incorporate that feedback without any obligation or compensation to you.
11Data Protection and Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy governs how we collect, process, store, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA), the Information Technology Act, 2000, the IT (Reasonable Security Practices) Rules, 2011, RBI data localization guidelines, the UK GDPR and Data Protection Act 2018, and where applicable, the GDPR.
11.1 Data Fiduciary and Processor Relationship
With respect to personal data of your end users (visitors to your website whose form submissions are processed by Spamvora):
- You are the Data Fiduciary / Data Controller — you determine why and how your end users’ data is collected;
- Spamvora is your Data Processor — we process end-user data only as necessary to deliver spam scoring results to you;
- You are solely responsible for having a lawful basis and your end users’ consent for this processing;
- You must display an adequate privacy notice on your own website that discloses the use of third-party spam protection services;
- Enterprise customers requiring a Data Processing Agreement (DPA) — including under UK GDPR Article 28 or GDPR Article 28 — may request one by emailing info@spamvora.com.
11.2 Payment Data
We do not store full payment card numbers, UPI IDs, bank account details, or CVV data. All sensitive payment information is handled exclusively by Razorpay under their PCI-DSS certified infrastructure. All payment data is stored within India in compliance with RBI guidelines.
11.3 Data Breach Notification
In the event of a personal data breach that is likely to result in risk to your rights, we will notify affected users as required under the DPDPA 2023, UK GDPR, and applicable law. We will notify the Data Protection Board of India where required, the UK ICO within 72 hours for UK users where required under UK GDPR, and the relevant EU supervisory authority within 72 hours for EU/EEA users where required under GDPR.
12Third-Party Services
The Service integrates with or depends upon the following third-party services:
- Razorpay Software Private Limited — RBI-licensed Payment Aggregator for all payment gateway processing, subscription billing, and GST invoice generation;
- Resend, Inc. — US-based transactional email delivery platform (SOC 2 Type II certified, GDPR and UK GDPR compliant);
- Amazon Web Services (cloud infrastructure) — hosting, storage, and API processing;
- WordPress.org — the CMS platform through which our plugin is installed and operated.
We are not responsible for the availability, accuracy, security, or conduct of any third-party service. Your use of third-party services is governed by their own terms and privacy policies, which we encourage you to review. We will use commercially reasonable efforts to notify you of material changes to critical third-party integrations that may affect your use of the Service.
13Service Availability and Modifications
We aim to maintain high availability of the Service but do not guarantee uninterrupted, error-free, or perfectly secure operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (communicated in advance where practicable via email through Resend);
- Unplanned technical failures or AWS infrastructure outages;
- Third-party service disruptions including Razorpay payment gateway downtime;
- Force majeure events including natural disasters, government actions, internet infrastructure failures, or civil disturbances.
We reserve the right to modify, update, suspend, or discontinue any feature, component, or the entire Service at any time, with reasonable advance notice where practicable. We will not be liable for any modification, suspension, or discontinuation of the Service.
14Disclaimer of Warranties
We do not warrant that:
- The Service will meet your specific business requirements or produce any particular outcome;
- The Service will be free from errors, bugs, data loss, or security vulnerabilities at all times;
- Results from the Service — including lead quality scores or spam classifications — will be 100% accurate;
- The Service will be compatible with all WordPress versions, themes, or third-party plugins.
To the extent implied warranties cannot be excluded under applicable mandatory law (including Indian consumer protection law, UK consumer rights law, or EU consumer protection directives), such warranties are limited to the minimum scope permitted.
15Limitation of Liability
Aggregate Liability Cap: Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the total subscription fees paid by you to Spamvora in the twelve (12) calendar months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under mandatory applicable law, including rights available to consumers under the Consumer Protection Act, 2019 (India), the Consumer Rights Act 2015 (UK), or equivalent EU consumer protection legislation.
16Indemnification
You agree to defend, indemnify, and hold harmless Spamvora, its proprietor, employees, contractors, agents, and licensors from and against any and all third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to the Service in violation of these Terms;
- Your violation of any applicable law, regulation, or third-party rights;
- Any content or data you submit through or in connection with the Service;
- Your failure to obtain proper consent from your end users for data processing activities;
- Any fraudulent chargebacks or payment disputes you initiate in bad faith through Razorpay or your bank.
17Termination
17.1 Termination by You
You may stop using the Service and cancel your account at any time through your dashboard or by contacting info@spamvora.com. Cancellation takes effect at the end of the current billing period.
17.2 Termination by Us
We may suspend or permanently terminate your access to the Service, with or without prior notice, if:
- You breach any material provision of these Terms and fail to remedy it within 7 days of notice;
- We are required to do so by applicable law, a court order, or a directive from the RBI, Data Protection Board of India, the UK ICO, or other regulatory authority;
- Your conduct poses an immediate risk to the Service, other users, or third parties;
- You engage in any Prohibited Activity listed in Section 9;
- You initiate a fraudulent chargeback or payment dispute in bad faith.
17.3 Effect of Termination
Upon termination, your right to access and use the Service ceases immediately. You may request export of your account data within 30 days of termination, after which we may permanently delete your data per our Privacy Policy. The following sections survive termination: 10 (Intellectual Property), 11 (Data Protection), 14 (Disclaimer), 15 (Limitation of Liability), 16 (Indemnification), and 18 (Governing Law).
18Governing Law and Dispute Resolution
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, and applicable RBI regulations, without regard to conflict of law principles.
18.2 Dispute Resolution
In the event of any dispute, claim, or controversy arising from or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation for a period of 30 calendar days from written notice of the dispute. If informal resolution fails, the dispute shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, India.
18.3 Consumer Rights (India)
Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019 or the Consumer Protection (E-Commerce) Rules, 2020. You retain the right to approach the appropriate Consumer Dispute Redressal Commission if you are not satisfied with our resolution.
18.4 Consumer Rights (United Kingdom)
If you are a consumer based in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation. You retain the right to escalate unresolved complaints to UK alternative dispute resolution (ADR) bodies or the UK courts.
18.5 EU Consumer Rights
If you are an EU consumer, you may submit disputes through the European Commission’s ODR platform at ec.europa.eu/odr. Our contact for ODR purposes is info@spamvora.com.
18.6 Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
19Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page;
- Notify active subscribers by email via Resend at least 14 days before material changes take effect;
- For non-material clarifications or minor corrections, post the update without separate notice.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms. If you do not agree to any changes, you must stop using the Service and cancel your subscription before the effective date.
20Grievance Officer and Contact Information
In compliance with the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023, we have designated a Grievance Officer for all legal, billing, and privacy-related complaints.
